In accordance with the E-Sign Act requirement, you have the right to obtain this disclosure in paper format. You may contact the Credit Union to obtain a paper copy of this disclosure at no charge.


This is your (also referred to as "subscriber") bill paying agreement with EPB Employees Credit Union (hereafter referred to as "Credit Union"). You may use the Credit Union’s Bill Payer Service (hereafter referred to as "Bill Payer" or "Service") to direct the Credit Union to make payments from your designated Share Draft (checking) Account (hereafter referred to as "Account") to the Merchants (vendors) you choose in accordance with this agreement. The terms and conditions of this Agreement are in addition to the Account agreements, disclosures and other documents in effect from time to time governing your Primary Share and Share Draft Accounts.

"You" and "your" means each person who signs the bill paying enrollment form or is otherwise authorized to access your account can use the Service. "Merchant" means anyone, including the Credit Union, you designate and the Credit Union accepts as a payee.

This service is not for everyone. Anyone with a history of NSF transactions, or who, in the opinion of the Credit Union, does not maintain his/her account in a responsible manner, may either be rejected from using, or terminated from, this Service, without advanced notice!

EPB Employees Credit Union has contracted with iPay, LLC to provide the processing and maintenance of this Bill Paying Service. From time to time, you will be directed to iPay for questions and inquiries regarding your Bill Payer account.

SIGNING UP

Please go on-line to complete a Bill Payer Enrollment Form. It will take approximately 1 - 3 days before you can pay your first bill on-line.

When you complete your Bill Payer Enrollment Form, you will be given an opportunity to request a UserID and Personal Identification Number (PIN). The Credit Union will make every effort to accommodate your request. The UserID and PIN are critical forms of identification. You are responsible for the maintenance and distribution of both the UserID and PIN. The use of both items when accessing the Bill Payer system is your authorization to perform bill payment requests.

Essential to the completion of the form is the "Security Word," "UserID," and "PIN." The Security Word (as well as your social security number, birth date and login ID) will be asked of you, should you phone in to ask about your Bill Payer account. The UserID is needed every time you access the system to inquire or to pay bills. The PIN will also be used by you whenever you access the system.

Once your on-line enrollment is approved, you will receive a "welcome" email stating that you are now able to use the Service.

ACCESSING THE SERVICE

Each time you access the Service, you will be asked to enter your UserID and PIN. Correct responses will permit access to the Service, whether or not the user is the subscriber. Guard your UserID and PIN to prevent entry by unwanted parties! If you feel that your account or method of access has been jeopardized, contact the Credit Union (423) 648-3413 as soon as possible, or, after hours, 866-804-8503.

HOW TO SET UP MERCHANTS/PAYMENTS

The member is responsible for entering into the system the correct bill payment information. Once in the Bill Payer system, use the "Add" button to add merchants/payments. Merchants/payments must be added to the system before they can be paid. You should have your entire billing statement available before entering the required information. Once a new merchant/payment is entered, there will be a one-day waiting period before a bill payment request can be entered.

The Credit Union is not responsible if a Bill Payment can not be made due to incomplete, incorrect, or outdated information provided by you regarding a Merchant or if you attempt to pay a Merchant that is not on your bill pay list. The Credit Union will NOT notify you of an unpaid bill request.

THE BILL PAYING PROCESS

The Credit Union will process variable payments on the business day (generally Monday through Friday, except holidays) you designate the bill is to be processed, provided the payment request is received prior to the cut-off time set by the Credit Union, which is currently 4:00 p.m. Eastern Time. Variable bill requests received after the business day cut-off time, or at any time on a non-business day will be processed on the next business day. The Credit Union reserves its right to change the cut-off time by giving you notice if it changes.

FOR RECURRING PAYMENT REQUESTS, IF YOU DESIGNATE A PROCESSING DATE OF THE 28TH THROUGH THE 31ST OF A MONTH, PROCESSING WILL BE INITIATED ON THE LAST CALENDAR DAY OF THE MONTH. Otherwise, recurring payment requests will be processed on the dates you have designated, unless such date falls on a non-business day resulting in your payment being processed on the next business day.

YOU MUST ALLOW AT LEAST FIVE (5) BUSINESS DAYS, PRIOR TO THE DUE DATE, FOR EACH BILL PAYMENT (RECURRING OR VARIABLE) TO REACH THE MERCHANT. (IT IS THE RESPONSIBILITY OF THE SUBSCRIBER TO SCHEDULE/ACTIVATE RECURRING PAYMENTS.)

You agree to have available collected funds on deposit in the account you designate in amounts sufficient to pay for all Bill Payments requested, as well as, any other payment obligations you have to the Credit Union. The Credit Union reserves the right, without liability, to reject or reverse a Bill Payment if you fail to comply with this requirement or any other terms of this agreement. If you do not have sufficient funds in the Account and the Credit Union has not exercised its right to reverse or reject a Bill Payment, you agree to pay for such payment obligations on demand. You further agree the Credit Union, at its option, may charge any of your accounts with the Credit Union to cover such payment obligations.

Any Bill Payment can be changed or cancelled, provided you access the Service prior to the cut-off time on the business day prior to the business day the Bill Payment is going to be initiated.

LIABILITY

You are solely responsible for controlling the safekeeping of, and access to, your Personal Identification Number (PIN). You are liable for all transactions you make or that you authorize another person to make even if that person exceeds his or her authority. If you want to terminate another person’s access, change your PIN immediately.

You will be responsible for any Bill Payment request you make that contains an error or is a duplicate of another Bill Payment. The Credit Union is not responsible for a Bill Payment that is not made if you did not properly follow the instructions for making a Bill Payment. The Credit Union is not liable for any failure to make a Bill Payment if you fail to promptly notify the Credit Union after you learn that you have not received credit from a Merchant for a Bill Payment.

The Credit Union is not responsible for your acts or omissions or those of any other person, including, without limitation, any transmission or communications facility, and no such party shall be deemed to be the Credit Union’s agent. In any event, the Credit Union will not be liable for any special, consequential, incidental, or punitive losses, damages, or expenses in connection with this Agreement or the Service, even if the Credit Union has knowledge of the possibility of them. The Credit Union is not liable for any act, failure to act or delay in acting if it is caused, in whole or in part, by any cause beyond the Credit Union’s reasonable control.

CHANGE IN TERMS

It may be necessary, from time to time, to change the terms or conditions regarding your Bill Pay account. In the event such a change is necessary, we will display a message on the Bill Pay main menu directing you to this page for an updated copy. This will take place at least 21 days prior to the date on which the change becomes effective. In the event an immediate change is required to maintain the security of your account or the Credit Union system, we shall notify you via e-mail within 10 days of making the change.

TERMINATION

The Credit Union has the right to terminate this Agreement at any time. You may terminate this Agreement by written notice to the Credit Union. The Credit Union is not responsible for any fixed payment made before the Credit Union has a reasonable opportunity to act on your termination notice. You remain obligated for any payments made by the Credit Union on your behalf.

The Credit Union will not tolerate termination requests solely for the purpose of avoiding NSF (non-sufficient funds) fees. Repeat NSF offenders will be terminated from the Bill Payer Service program immediately and without advance notice!

FEES

Fees associated with this program may be adjusted from time-to-time to cover the costs of doing business. Recurring fees will be assessed based on the subscription plan. There are two Bill Payer Service plans: the Limited Plan and the Unlimited Plan.

The Limited Plan costs $2.00 per month plus forty cents ($0.40) per item. The Unlimited Plan costs $6.00 per month with no fee per item. (Suggestion: if you plan to pay 1-10 items per month, select the Limited Plan. If you will have 11 or more items per month, use the Unlimited Plan as it becomes less expensive.) Please note that you will be charged either $2.00 (Limited) or $6.00 (Unlimited) each month, even if you do not use the Bill Payer Service that month. To prevent fees, you must contact the Credit Union to terminate your Bill Payer Account Service. You must also contact the Credit Union if you want to change Plans.

In addition to the monthly fee, the following charges (regardless of Plan) will be assessed if you use one or more of the services listed here. There will be NO charge for any item if needed to correct a Credit Union error:

$12.00 - For a standard proof of payment (i.e., copy of cancelled check)
15.00 - Per letter mailed Express Mail
20.00 - Return check/ACH fee
8.00 - Per cancellation of each request for payment before disbursement
5.00 - For return payment due to any error.

The Credit Union reserves the right to charge you for research involving payments no longer available in your screen history. The research rate is $25.00 per hour, minimum one-hour charge, rounded to the nearest half-hour.

ACCESS REQUIREMENTS

You need a computer, related equipment, and an Internet connection in order to use Bill Payer. In addition, you may need to install Internet brower software if you do not already have it. Modifications to the services in the future may require installation of upgrades to the browser's software. You are responsible for installation, maintenance, and operation of your browser's software.

It is your sole responsibility to insure your personal computer and related equipment are compatible with and capable of operating in a manner that allows you to utilize Bill Payer services.
